Veterinary Medical Examining Board" -
The Veterinary Medical Examining
Board has been receiving calls from veterinarians asking what they can do about
an animal that is suffering and the client can’t
be reached. The “Abandoned Animal” law in the Practice Act states
that you must wait 12 days from the mailing of a certified letter to the last
known address of the owner before you can take any action.

Health Department Clarification of Act 159
The Arkansas Department of Health is offering further clarification of
Act 159 for Arkansas citizens concerned about vaccination of their dogs
and cats. Act 159, an act to modernize Arkansas’s rabies control
and to empower the State Board of Health to establish reasonable vaccination
requirements against rabies, was signed by Governor Beebe on February 16th.
This act updates the Rabies Control Act removing extensive obsolete sections.
The main change of interest to citizens is the interval for rabies vaccinations
for dogs and cats. The old act required rabies vaccines to be given yearly.
The new act requires “All dogs and cats shall be vaccinated against
rabies annually or as required by the State Board of Health.” The
Administrative Procedures Act for changing rules and regulations established
by the State Board of Health will take some time. Until these rules and
regulations are changed, the requirement will remain for dogs and cats
to receive their rabies vaccinations annually.

The Arkansas VMA is getting in
step with social networking! We
know have a Face Book page. The
only requirement for full access by
members is to have a personal Face
Book page. We are also pleased to
announce the list serve is up and
running. You can sign up by visiting
the Arkansas VMA web site, www.arkvetmed.org, and clicking on the
list serve icon.
The Red Flag Rule goes into effect
August 1st, 2009. The accompanying
article in the newsletter explains
how this new IRS regulation affects
our profession and how our practices
get in compliance.
I also want to suggest that everyone
review the sales tax regulations
as they pertain to your business.
There are an increasing number of
sales tax audits of veterinary practices
in Arkansas by the Department
of Finance and Administration in
which they are finding fault with
proper sales tax compliance. It is
not the Arkansas VMA’s purpose
to interpret the sales tax code as
it pertains to veterinarians, but to
keep the membership aware that
they should seek DFA advice as to
the sales tax regulation as it relates
to your individual practice.
Dr. Rene Lavergne has an excellent
summer meeting agenda in
Branson, Missouri August 7-9. I
look forward to seeing everyone
there. Also, don’t forget to mark
your calendar for the Southwest
Veterinary Symposium, September
24-27, in San Antonio, Texas.
Last, I want to take the opportunity
to thank those of you who sent
their condolences and memorials
upon the sudden passing of my
wife, Beverly. Our family deeply
appreciates everyone’s thoughts and
prayers during this difficult time.
